Woodside Village HOA - SB 137 revises the procedures for collecting delinquent assessments
SB 137 revises the procedures for collecting delinquent assessments for certain debts that arise on and after January 1, 2006. The law provides that when an association of a common interest development seeks to collect delinquent assessments of less than $1,800, not including accelerated assessments and specified late charges and fees, the association must either file a civil action in small claims court or record a lien but the association would be prohibited from foreclosing on this lien until the amount equals or exceeds $1,800 or the assessments are more than 12 months delinquent.

New law could curb car towing abuses
All I have to do is say "vehicle towing abuses,’’ and I will get a flood of mail to the San Jose Mercury News Action Line column. It is a nationwide scandal and now the feds have stepped in. Towing Deep in the new highway bill passed by Congress on Friday is a provision that allows states to require a property owner to authorize and be present at each tow, the New York Times reported on Sunday. That was the law in California until a federal appeals court invalidated the law in 2000. The paper said that that led to "a rise in ‘patrol towing’ in which tow trucks police parking lots and remove cars at their own discretion. Have you got a towing horror story to share? Folks, today I went to ask Manager Saeid Hariri to reconnect gas supply to my unit so I will not freeze my ass off. He refused even though it violates CC&Rs..

Being a looser, manager Hariri will shut off gas to all units to save couple bucks so he can make up for his over compensation in salary, pension and health plan which is costing us over $150,000.00 per year.

FYI: The manager Saeid Hariri was recently fired from the Aliso Creek Villas Condominium Association and the South Coast Terrace Condominium Association as an incompetent, abusive and untrustworthy manager. In addition he was sued by both the Aliso Creek Villas Condominium Association and the South Coast Terrace Condominium Association for the misconduct and violation of the fiduciary duty.

Editorial opinion:
In the above ruling the Court upheld California Vehicle Code section 22658(l)(1). This statute provides that when a towing company tows a vehicle from private property without the vehicle owner’s permission, the company must obtain written authorization from either the property owner or the property owner’s agent. It also requires that the property owner or agent be present for the tow.

The ruling has no effect o the Woodside Village HOA predatory towing because the owner or agent is present for the tow. (See FN1 below)

Therefore, in the Woodside Village HOA the violation of the law arises from unlawful financial kickbacks distributed between the Association, Towing and Security companies.

(FN1) It appears that "property owner’s agent" is the association's managing agent Saeid Hariri, rather then Gosha Security, who must be present for the tow.
